You may request a deferred sentence on citations with 4 points or less:
- If you are currently on a deferred, have had a deferred within the last three (3) years or have point violations on your record within three (3) years, you are not eligible to request a deferred.
- If the deferred is granted, you will pay a fee to the Court (fine + costs), be required to take a defensive driving class (at your own expense) and have no moving violations during the deferment, which is for a period of one year. The points will not be reported to the State as long as you complete the conditions of the deferred.
- A deferred must be requested prior to entering a plea of not guilty and setting a trial date
You may request a point reduction or a deferred on citations with 6 points.
- If you are currently on a deferred, have had a deferred within the last three (3) years or have moving violations on your record within three (3) years, you are not eligible to request a deferred.
- If a point reduction is granted, you will pay the fine + costs.
